Especialista Derecho del ARte UC3M

The student of the Specialist Title in Art Market Law will learn about the particular legal questions arising in the art market.  The title covers the legal protection of works of art, from the point of view of Intellectual Property as well as the rules protecting cultural goods, and the particularities of the right of property of art works.  We shall also analyse in depth the different contracts over art works (sale, deposit, loan, donation, transport, insurance) pointing out the special issues that have to be considered in the art market (v.gr. authenticity, acquisition of good title) and study the regulation of export and import controls on works of art.  Furthermore, the legal framework of the activity of the agents in the art market is studied (artists, collectors, auction houses, experts, galleries, restorers, etc.) outlining its particularities (v.gr. obligation of professionals sellers to provide information, special liability regime of auction houses).  The course also covers the taxation of artists and collectors as well as transfers of works of art and art foundations.  Finally, several legal questions relating to art and business are considered (financial contracts over art works or business patronage).  All of this is done with a dual approach, theoretical and practical. For this purpose, the specialist title in Art Law has experienced professionals in Art Law in the team of teachers.

The students who fulfil the Specialist Title in Art Market Law shall be capable to give comprehensive legal advice in matters of Art Law. They will be able to identify potential problems that arise from the circulation of works of art and take the necessary measures to solve them.
